1. Acceptance of Terms

By accessing or using BusinessOS ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users, including organization owners, administrators, and members.

2. Description of Service

BusinessOS provides a business operating system that includes customer relationship management (CRM), communications (email, SMS, voice), billing management, workflow automation, and related features. The Platform is offered on a subscription basis with different plan tiers.

3. User Responsibilities

  • You must maintain the confidentiality of your account credentials and two-factor authentication device.
  • You are responsible for all activity that occurs under your account.
  • You must not use the Platform for any unlawful purpose or in violation of any applicable laws.
  • You must not attempt to gain unauthorized access to any part of the Platform.
  • You must not use the Platform to send unsolicited messages (spam) or harass others.
  • Organization owners are responsible for their members' compliance with these terms.

3a. Enterprise Identity and SSO

BusinessOS supports integration with enterprise identity providers for centralized user management:

  • Single Sign-On (SSO): Organizations using SSO authenticate through their identity provider (Microsoft Entra ID, Google Workspace, Okta, or other OIDC/SAML providers). When SSO is enforced, BusinessOS-managed passwords are disabled and all authentication is routed through the configured provider.
  • SCIM Provisioning: When enabled, user accounts are automatically created, updated, and deactivated by the identity provider via the SCIM 2.0 protocol. Organizations using SCIM must maintain accurate user records in their identity provider, as BusinessOS syncs users directly from provisioning events.
  • LDAP/Active Directory: Organizations connecting via LDAP authenticate against their directory server. LDAP users are provisioned and updated on each login based on directory attributes.
  • External Identity: When you authenticate via an external identity provider, you grant BusinessOS permission to access your name, email, and profile picture from that provider. This information is used solely for account creation and authentication.
  • Account Deactivation: When a user is deactivated in the external identity provider, their BusinessOS access is revoked on the next sync cycle or SCIM deprovisioning event. Deactivated users' data remains in the organization for the retention period specified in the Privacy Policy.
  • Organization Owner Responsibility: Organization owners and administrators who configure SSO, SCIM, or LDAP integrations are responsible for managing user access through their identity provider. BusinessOS is not responsible for access issues caused by misconfigured identity provider settings.

4. Billing and Payments

BusinessOS offers both subscription-based and usage-based billing:

  • Subscription Plans: Seat-based monthly or annual billing processed through Stripe. Annual billing offers a 15–20% discount.
  • Prepaid Credits: SMS, voice calls, phone number rentals, and AI execution are billed from a prepaid credit balance. Credits are purchased in advance via Stripe and deducted at transparent per-unit rates.
  • Auto-Recharge: If enabled, your saved payment method will be charged automatically when your credit balance drops below a configured threshold.
  • Free Tier: The free plan provides limited functionality at no cost. We reserve the right to modify free tier limits with reasonable notice.
  • Trial Periods: Paid plans may include a free trial. At the end of the trial, your subscription will automatically begin unless cancelled.
  • All payments are non-refundable except as required by law.

5. Phone Numbers and Telephony

BusinessOS provides phone number management as a reseller service:

  • Phone numbers are purchased through BusinessOS and billed monthly from your credit balance at published rates.
  • Number porting (transferring an existing number from another carrier) is supported. Porting typically takes 1–3 business days and requires your account number and PIN from the losing carrier.
  • Call recordings may be stored on the platform. You are responsible for complying with applicable recording consent laws in your jurisdiction.
  • We are not responsible for service interruptions caused by the underlying telephony provider.

6. AI Features

BusinessOS includes AI-powered features that process your data to provide assistance:

  • AI agents analyze your contacts, communications, and pipeline data to generate suggestions, summaries, and recommendations.
  • AI-generated content (suggested replies, action recommendations, sentiment analysis) should be reviewed before use. AI outputs may contain errors.
  • You control which AI agents are active for your organization and can approve or reject AI-suggested actions.
  • AI execution is billed from your prepaid credit balance at published per-execution rates.

7. Data Ownership

You retain full ownership of all data you enter into BusinessOS, including contact information, communications, and business records. We claim no intellectual property rights over your data. We will not use your data for purposes other than providing the service to you.

Enterprise Identity Data: When using SSO, SCIM, or LDAP integrations, BusinessOS stores identity-related attributes (external user IDs, provider organization IDs, and sync metadata) to maintain the link between your BusinessOS account and your identity provider. This data is controlled by your identity provider and can be removed by disconnecting the integration.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to perform maintenance, updates, and upgrades that may temporarily affect availability. We will provide reasonable notice for scheduled maintenance.

9. Limitation of Liability

BusinessOS and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability is limited to the amount you've paid in the 12 months preceding the claim.

10. Termination

Either party may terminate your account at any time. Upon termination:

  • Your access to the Platform will be revoked.
  • Your data will be retained for 30 days, after which it will be permanently deleted.
  • You may request a data export before termination takes effect.
  • For organizations using SSO or SCIM, the identity provider integration will be disconnected upon termination. Any users provisioned through SCIM will be deactivated in BusinessOS.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email and in-app notification. Continued use of the Platform after changes constitutes acceptance of the new terms.
